Purpose
Israel provides individual coaching and consulting to help clients develop and implement strategies of enhanced business performance and/or personal satisfaction.
Through an interactive and developmental coaching process, Israel guides his clients through strategies and solutions designed to move them towards the attainment of defining and accomplishing professional and personal goals. He respects, acknowledges, and protects the vulnerability and confidentiality of each client, while constructively holding clients to high standards of self-responsibility and self-accountability.
Israel is not a certified coach, but he upholds the International Coach Federation Code of Ethics.
Feedback
If, at any time, you (the client) feel that your needs are not being met or you are not getting what you want out of the individual coaching/consulting, please tell Israel so you can discuss your needs and adjust your coaching or consulting program.
Sessions
Consulting is scheduled at the mutual convenience of the consultant and the client.
In most cases, coaching will be conducted via an Audio or Video “Zoom Room,” as agreed upon by both parties. Please remember that you must give 24 hours prior notice if you need to cancel or change the time of an appointment, otherwise you will be charged for the session in full. Israel will make reasonable efforts to reschedule sessions, which are canceled in a timely manner. Either party may end the coaching relationship at any time, by giving written, email, or verbal communication of their desire to end the coaching sessions to each other, however charges may apply based upon the separate payment agreement you have entered into with Israel Duran & Associates LLC.
Confidentiality
Israel respects your confidentiality and will only release information with your written permission, if he is required to do so by a court order, or if he believe you are in danger of hurting yourself or others. These situations rarely occur in coaching practices, but if such a situation does occur, he will make every effort to discuss it with you before taking any action.
Although, during the course of your consulting/coaching, you may discuss your future plans, business affairs, customer lists, financial information, job information, goals, personal information, and other private information, Israel will not voluntarily communicate your information to a third party.
Consulting versus Psychotherapy
There are some similarities between coaching/consulting and psychotherapy, but Israel is not a licensed therapist or licensed coach and you will not be receiving therapy. Although both coaching and psychotherapy use knowledge of human behavior, motivation, behavioral change, and interactive counseling techniques, there are major differences in the goals, focus, and level of professional responsibility. In rare situations, Israel may recommend that you enter psychotherapy (with a psychotherapist or counselor) as a condition of continuing coaching.
Professional Boundaries
Coaching/Consulting is a professional relationship and Israel will maintain professional boundaries during and after your work together. Considerable experience shows that when boundaries blur, the hard-won benefits gained from the coaching relationship are endangered.
Intellectual Property
In order to honor and protect the coach’s intellectual property, (you) the client agree not to disclose or communicate information about the coach’s materials, written articles, or methods to any third parties without express permission. Israel will also protect any client intellectual property or personal/business information that may be discussed.
Informed Consent
Business coaching with Israel Duran is designed to help you enhance and improve all aspects of your personal and professional life, using the coaching calls for strategizing, brainstorming, goal setting and planning. Your specific progress is based on your ability to implement the plan you develop and any and all situations that may affect your goals; as such, coaching offers no guarantees of your financial progress.
Hold Harmless
In his role as a business coach, Israel may make suggestions or offer advice, resources and recommendations for his clients. But each client assumes sole responsibility to decide what actions to take regarding his/her business plan and/or career development path. Given this coaching contract, all clients agree to hold Israel harmless for the state of their businesses or careers, as well as taking total responsibility for their own results apart from coaching. Clients will indemnify and hold Israel Duran and Israel Duran & Associates LLC harmless from any legal claims, actions, or judgments.
Class Action Waiver
You may only resolve disputes with us on an individual basis, exclusively by binding arbitration, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed. See complete Terms of Service for details.
NO REFUNDS
Unless otherwise stated in writing with respect to particular Services offered for sale via this Website, Israel Duran & Associates abides by a strict, no refund policy. By accepting these Terms, You agree and understand that you are foregoing the right to claim any refund of fees paid for access and use of the Services offered via this Website.
NO WARRANTIES
By accepting these Terms, You agree and understand that We provide business coaching services only and guarantee no specific results. You acknowledge that We make no promise or representation that You will make a certain amount of money, or any money, or that you will not lose money, as a result of using these Services.
Any earnings, revenue, or income statements viewable on this Website or our related Social Media are based on actual individual results of our clients and/or estimates as may be stated. There is no guarantee that you will make these levels for yourself. As with any business, Your results will vary and will be based on your personal abilities, experience, knowledge, capabilities, level of desire, and an infinite number of variables beyond Our control, including some variables that neither We nor You may have anticipated. There are no guarantees concerning the level of success You may experience. Each person’s results will vary.
There are unknown risks in any business, particularly with the Internet where advances and changes can happen quickly. The use of our information, products and services should be based on your own due diligence and YOU AGREE THAT WE ARE NOT LIABLE FOR YOUR SUCCESS OR FAILURE.
In accepting these Terms, You acknowledge that You take full responsibility for your own success.
In no event will We be liable to You or any party related to You for any damage, including damages for loss of business profits or other pecuniary loss, whether under a theory of contract, warranty, tort (including negligence) products liability or otherwise, even if We have been advised of the possibility of such damages. As such THE SERVICES, CONTENT AND ALL DOWNLOADABLE SOFTWARE ARE DISTRIBUTED AS AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICES IS AT YOUR OWN RISK.
Limitations herein described shall be applied to the greatest extent enforceable under applicable law.

Hiring Israel as a consultant or coach signals agreement with this coaching contract.
